Introduction
Until recently, any discussion of the legal protection of human rights in England and Wales has taken place in a context of civil liberties, not civil rights.
This distinction was not simply a matter of a choice of words, but had profound consequences for the nature of freedom in this country.
To say that a person is at liberty to do something is fundamentally different from Freedom in English law had always been an saying that a person has a right to do something.
essentially residual concept-one was free to do everything left over once the law had said what one cannot do..
مقدمه
تا همین اواخر، هر بحثی پیرامون حمایت قانونی از حقوق بشر در انگلستان و و لز در بافت (بستر) آزادی های مدنی و نه دربافت (بستر) حقوق مدنی، اتفاق افتاده است.
این تمایز صرفاً موضوعی در مورد انتخاب کلمات ،نبود بلکه پیامدهایی عمیق برای ماهیت آزادی در این کشور داشت.
اینکه شخصی برای انجام کاری آزاد است اساساً متفاوت از گفتن این است که شخصی حق دارد کاری را انجام دهد.
آزادی در ذاتاً « باقیمانده بوده است بدین معنی که یک فرد برای انجام هر کاری آزاد بود مگر زمانی که قانون گفته حقوق انگلستان همیشه مفهومی بود آن فرد چه کاری را نمی تواند انجام دهد.
